The Ombudsman is to be given control over citizens' rights during a state of emergency.
As part of this initiative, it is proposed to supplement Article 15 with new provisions that will grant the akyikatchi (ombudsman) the authority to exercise parliamentary oversight over the observance of human rights and freedoms in conditions of martial law.
According to the explanatory note, the need for amendments is prompted by the requirements of Article 109 of the Constitution, which stipulates that the ombudsman institution is responsible for parliamentary oversight in this area.
Although the current law on martial law describes the procedure for the operation of state bodies, restrictions on citizens' rights, and security measures, it does not specify which body should exercise parliamentary oversight over citizens' rights in conditions of martial law.
The changes proposed in the draft law aim to strengthen the role of the ombudsman in protecting human rights during martial law and ensure the uninterrupted functioning of the akyikatchi institution and its apparatus.
It is noted that this legislative change will not require additional financial costs and will not lead to negative social, economic, or legal consequences.
