The deputy asked how the amendments to the Criminal Code of the Kyrgyz Republic will be applied using the example of detained law enforcement officers.
One of the most debated aspects of the new bill was the addition to Article 50 of the Criminal Code, which states that "causing harm is not a crime if it occurs in the lawful performance of legal obligations or for the purpose of protecting sovereignty and the constitutional order...".
Gulya Kozhokulova expressed her doubts about this, referring to recent criminal cases initiated against some employees of the GKNB.
She asked the question: "General Prosecutor's Office, as the supervisory authority, what is your position on this point? Considering the recent cases against the leadership of the GKNB… It is stated here that a person is not liable for an order or official duties if they were unlawful. So who determines this lawfulness?"
In response, Deputy General Prosecutor Umutkan Konkubayeva noted that this amendment had been excluded.
She clarified: "The General Prosecutor's Office is not the initiator of this bill. Regarding Article 50, during the second reading, this addition was excluded, and the previous version remained."
