In Kyrgyzstan, a proposal is made to ban gender reassignment.
The draft proposes that sex is determined solely based on biological characteristics established at birth, and this information cannot be changed either at the request of citizens or based on medical conclusions or court decisions. The only exceptions are corrections of technical errors made by civil registry employees.
Additionally, it is planned to add a provision to the Family Code that will enshrine biological sex as the only permissible category for regulating family relationships, including marriage, as well as the establishment of motherhood and fatherhood.
Parents will also be required to raise their children according to their biological sex.
Changes to the Law "On Civil Status Acts" emphasize that the entry regarding sex in the birth certificate is final and cannot be changed thereafter. The draft law also establishes a procedure for correcting only technical errors that occurred during the initial registration.
Significant changes are being made to the Law "On the Protection of Citizens' Health," under which medical procedures aimed at changing sex, including surgeries and hormone therapy, will be prohibited. The only exceptions are rare cases of treating congenital anomalies of sexual development, which must be confirmed by a medical commission and a court decision.
The authors of the draft law emphasize its focus on protecting family values and preventing legal conflicts, as well as strengthening personal data accounting systems.
The explanatory note states that current legislation does not contain clear norms regarding the change of sex, which creates risks for demographic policy, child protection, and the stability of document circulation in the state.
The draft law is available for public discussion on the Jogorku Kenesh website and will be presented for consideration by parliamentary committees after the discussion concludes.
