Factories near homes? A new bill allows for forced demolition
This draft law envisions the creation of zones where industrial activities will be restricted or completely prohibited if they pose a danger to public health or cause harm to the environment. SPCZs can be established both within populated areas and in adjacent territories where residential buildings, educational institutions, medical facilities, recreational areas, and agricultural lands are located.
According to the proposed amendments, the SPCZ regime will be introduced upon the occurrence of at least two confirmed cases of exceeding permissible levels of harmful emissions, noise levels, road damage by heavy machinery, or the absence of wastewater treatment systems at enterprises. In such zones, the construction and expansion of production facilities will be prohibited, which may exacerbate the situation.
The Land Code is planned to be supplemented with a provision allowing for the expropriation of land plots and the demolition of structures within SPCZs to eliminate ecological threats.
To avoid expropriation, landowners will be able to sign an agreement for modernization and the implementation of best available technologies during a transitional period of up to two years, with the possibility of extending it for another year.
Additionally, the draft provides for a mechanism to offer equivalent plots in industrial zones for the relocation of production facilities.
The explanatory note emphasizes that the changes aim to prevent urban planning conflicts, reduce harmful impacts on citizens' health, and protect residential areas from uncontrolled industrial influence.
