The GKNB detained a man near a bank while receiving 3000 dollars — the court issued a verdict

The judicial panel of the Bishkek City Court has decided to terminate the criminal case against two men suspected of fraud.

As reported by the press service of the GKNB in July 2024, one of the suspects was detained. The investigation established that T.T.K., using the name of GKNB employees, extorted money from a Chinese citizen, promising a favorable resolution to a criminal case that was under consideration. He managed to receive 18 thousand dollars but was detained on July 10 while attempting to collect another 3 thousand dollars. At that moment, he was in the temporary detention facility of the Bishkek City Department of Internal Affairs.

According to the case materials published in the State Register of Judicial Acts, T.T.K. and his accomplice D.A.A., acting out of selfish motives and having previously conspired, decided to obtain a large sum of money from the Chinese citizen Ch.V., who was under investigation for the illegal import of goods.

The investigation found that, understanding that Ch.V. was a foreigner and did not speak Russian, T.T.K. and D.A.A. intimidated him, threatening imprisonment and deportation if he did not pay the sum of 18 thousand dollars. From December 2023 to March 2024, Ch.V., fearing for his freedom, transferred money to T.T.K. in parts to terminate the investigation.

However, as investigators discovered, T.T.K. and D.A.A. used the funds received for personal interests. Moreover, in early June 2024, they again threatened Ch.V., demanding an additional 3 thousand dollars under the pretext of compensation for damages.

To obtain this amount, D.A.A. provided the bank account number of his godson T.T.K., to which the specified amount was to be transferred, although in reality, they planned to embezzle this money. Ch.V., not understanding the laws of Kyrgyzstan, agreed to the demands of the fraudsters and filed a complaint about extortion with the GKNB.

As a result of operational actions, on July 10, 2024, at 11:45, T.T.K. was detained near one of the banks in Bishkek, where 3 thousand dollars were found during a search, copies of which had been made earlier.

According to the decision of the Pervomaisky District Court dated April 28, 2025, T.T.K. was found guilty of fraud and received a 3-year prison sentence; however, based on Article 82 of the Criminal Code, he was released from serving his sentence under probation supervision for 1 year. The measure of restraint in the form of house arrest was changed after the verdict entered into legal force.

D.A.A. was also found guilty of fraud and received a similar sentence with probation supervision. His measure of restraint in the form of a written undertaking not to leave was revoked after the verdict came into force.

The court ruled that T.T.K. and D.A.A. must pay Ch.V. 715,360 soms as compensation for damages within 6 months. Dissatisfied with the verdict, Ch.V.'s representative J.U. filed an appeal requesting a stricter punishment for the defendants.

D.A.A. also filed an appeal, asking for the verdict to be overturned and for him to be acquitted. During the court proceedings, the lawyer filed a motion to terminate the case due to reconciliation between the parties, as an agreement on compensation for damages had been reached between the victim and the defendants.

At the court hearing, the defendants confirmed that they had reconciled with Ch.V. and requested the termination of the case. The representative of the victim supported this agreement.

Having reviewed the case materials, the judicial panel decided to overturn the verdict of the Pervomaisky District Court regarding T.T.K. and D.A.A. The criminal case was terminated due to reconciliation between the parties, and the measures of restraint against the defendants were revoked.

The ruling may be appealed to the Supreme Court in cassation.
