Hunter with a gun and a group of teenagers: Court toughens sentence and gives 12 years for the murder of a schoolboy

The Collegium of the Jalal-Abad Regional Court reviewed the verdict in the case of the murder of a 15-year-old boy in the Nooken district and sentenced the accused to 12 years of imprisonment.

  • The details of the case were extracted from the State Register of Judicial Acts.

The court established that on the night of August 25 to 26, 2023, B.K.S., a resident of the Nooken district born in 1981, was near the post office building in the village of Shaidan. He fired a shot from a hunting rifle of the brand "MOSSBERG-930" towards a group of teenagers. As a result of the shot, a fatal injury was sustained by a teenager named M.E.T. (name changed), born in 2008, who died in the intensive care unit of the district hospital without regaining consciousness.

Previously, the Nooken district court qualified B.K.S.'s actions as murder under a less serious part of the article, sentencing him to 8 years in prison. However, the prosecutor's office appealed this decision, pointing out the incorrect application of the law and the dangerous nature of the shooting.

Witnesses E.T. and D.T., who were interrogated during the investigation and at the court hearing, reported that they were at the scene. They stated that they were sitting with the victim when B.K.S. drove up in his car and began to take out a weapon. Hearing shouts of "they're shooting, run," they tried to escape, but B.K.S. fired in their direction and then left. Upon returning, they saw Erkin on the ground and tried to help, but noticed that he had sustained a gunshot wound to the head. E.T. added that his uncle O.T. took the injured person to the hospital.

In his testimony, B.K.S. claimed that he saw E.T. at the location where he had previously been beaten, and feeling threatened, he took his hunting rifle "MOSSBERG-930" and ammunition, loaded the weapon, and fired in E.T.'s direction. As a result of the shot, the bullet ricocheted and hit Erkin, causing his death.

The accused emphasized that he did not intend to kill and that the tragedy occurred accidentally, as he only wanted to scare his opponent, who had threatened him.

  • B.K.S., born in 1981, was born in the Nooken district, is married, and has three children. He had a previous conviction and is a hunter with the appropriate permits.

The court concluded that the district court incorrectly assessed the actions of the accused, failing to take into account that he deliberately left his home with a weapon and fired at a group of people.

Thus, the Appeals Collegium of the Jalal-Abad Regional Court on November 24, 2025, recognized the verdict issued by the Nooken court on June 9, 2025, as unfounded and reviewed it, finding the accused guilty under Article 122, Part 2, Clause 6 of the Criminal Code of the Kyrgyz Republic, qualifying the actions as murder committed in a manner dangerous to the lives of many people, and sentencing him to 12 years of imprisonment. The appeals from the defense were rejected.
