Kyrgyzstan has proposed the creation of a quasi-appeal mechanism to address issues related to barriers within the Eurasian Economic Union (EAEU). This was announced by Kaniyet Nasirdinov, head of the integration development sector of the EAEU coordination management at the Ministry of Economy and Commerce, during a radio program.

Nasirdinov noted that despite being a member of the EAEU, each country seeks to protect the interests of its producers to a certain extent. He emphasized: “Even though we are in a union, each state tries in one way or another to protect its domestic producers, and this happens in different ways — some do it more gently, others more openly.”

According to the ministry representative, there is already a legal framework and methodology in place to qualify, identify, and eliminate barriers in such situations. Appeals from businesses are considered at commission meetings, where a legal assessment of the situation is conducted. If a barrier is confirmed, information about it is published on the commission's website and has a reputational character, while the state is given time to eliminate the identified violations.

However, Nasirdinov pointed out that in some cases, the process of eliminating barriers is prolonged due to differences in law enforcement practices and interpretations of norms. In this regard, the Kyrgyz Republic has proposed the establishment of a quasi-appeal instance. This will allow parties who disagree with the commission's decisions to appeal to the EAEU Court. After receiving a judicial opinion, the issue will be reconsidered by the commission.

“We insist on the integrity of this process,” Nasirdinov added, noting that the relevant measures could be implemented as early as this year. He also reminded that all member states of the union, including Kyrgyzstan, have certain restrictions to support national businesses. “The EAEU was not created to completely eliminate barriers, but to reduce them,” he concluded.
