During the session of the Jogorku Kenesh, a bill concerning amendments to the Law of the Kyrgyz Republic "On State Procurement" was adopted, which went through three readings.
The main initiator of this bill was the Chairman of the Cabinet of Ministers, while the Minister of Economy and Commerce, Bakyt Sydykov, presented its main provisions.
According to the minister, the proposed changes are aimed at optimizing and simplifying the state procurement process. The new law introduces the concept of a state assignment, which will allow for more effective resolution of important strategic tasks of the state. Improving legal regulation in this area should contribute to sustainable development and strengthen the institutional structure of the country.
According to the new document, competitions and transparent procedures will no longer be mandatory. Legal entities with a share of state participation will be able to become executors of state assignments. It is also stipulated that the general contractor may transfer up to 50% of budget funds to subcontracting organizations, which may reduce the level of competitive control over the expenditure of funds.
Among the areas proposed to be transferred to a new funding format are:
- construction and maintenance of roads of international and republican significance;
- the field of education, science, and healthcare;
- culture, tourism, and preservation of historical heritage;
- modernization of fixed assets and development of economic sectors.
Special attention is also paid to ensuring the activities of the Presidential Administration and organizing official events with the participation of high-ranking officials and foreign delegations.
During the discussion, Deputy Suyunbek Omurzakov raised the issue of Article 2, paragraph 5 of the law, which states that amendments may be made no more than once a year.
Deputy Dastan Bekeshev expressed concerns about corruption risks associated with the selection of subcontractors and interactions between state enterprises and the private sector.
Kunduzbek Sulaymanov, another deputy, supported the proposed changes, noting that the bill is aimed at more effective use of budget funds in state procurement.
Medербек Aliyev emphasized that the new provisions of the law meet modern requirements, adding that during tenders, procuring organizations often focus on the lowest price, which can negatively affect the quality of the goods and services purchased.
