This document will be submitted to the Jogorku Kenesh for the necessary domestic procedures.
In the conclusion, it is noted that the so-called "IV Big" protocol was developed as a result of the work of a consolidated working group that worked on improving the provisions of the EAEU Treaty from 2022 to 2024. The Protocol includes 33 amendments.
The amendments aim to eliminate existing gaps in legislation, clarify definitions, and grant the Eurasian Economic Commission the authority to approve the methodology for qualifying obstacles in the EAEU internal market and recognizing barriers as eliminated.
Among the most significant changes mentioned in the conclusion:
- adjustments to the annexes of the Treaty (in particular, No. 5, 9, 10, 16, 19, 21), which concern the exchange of information on import duties and clarification of certain terms;
- replacement of the indicative LIBOR rate with SOFR in US dollars in investment provisions;
- clarifications regarding the enforcement procedure for EEC decisions and the procedure for transferring fines;
- introduction of the possibility of using electronic permits for international road transport within the framework of transport control at the external border of the EAEU;
- changes in the field of public procurement, including mutual recognition of bank guarantees and expansion of the list of cases for single-source procurement, as well as requirements for publishing information on the web portal;
- technical amendments and updating the name of the capital of Kazakhstan in several annexes (replacing "Nur-Sultan" with "Astana").
The document also emphasizes that in connection with the signing of the protocol by the heads of the EAEU member states at the meeting of the Supreme Eurasian Economic Council, it must undergo mandatory ratification and the corresponding domestic procedures. Previously, this protocol was approved by the Cabinet's order dated January 9, 2025, under number 1-r.
In addition, the text of the protocol was reviewed and approved by the relevant committees of the Jogorku Kenesh (conclusions dated November 26, November 28, and December 5, 2024).
It is also noted that this protocol complies with the Constitution and legislation of the Kyrgyz Republic, and its ratification will not lead to social, economic, legal, environmental, and financial consequences.
