The Ombudsman of Kyrgyzstan reported that the institute's staff was denied access to the territory of the Temporary Detention Center for Foreign Citizens twice.
Jamila Dzhamanbaeva, Ombudsman of the Kyrgyz Republic, calls on the relevant state authorities to pay attention to the conditions of detention and the protection of the rights of detainees in the Temporary Detention Center for Foreign Citizens and Stateless Persons, located at the former military base "Gansi" in the Chui region.
The Ombudsman emphasizes the necessity of adhering to the norms of the Constitutional Law "On the Ombudsman of the Kyrgyz Republic" and calls for the prevention of obstacles for the institute's staff in carrying out their professional activities.
According to Dzhamanbaeva, there have been two recorded instances of denial of access to the institute's staff to the territory of the Temporary Detention Center.
This violates the Constitutional Law "On the Ombudsman of the Kyrgyz Republic," which guarantees unhindered access for institute staff to places of detention and also implies responsibility for denying access.
The Ombudsman Institute perceives such systematic denials as a troubling signal indicating potential attempts to conceal human rights violations in this center.
On October 28, staff from the institute attempted to monitor the observance of the rights of detainees; however, they were denied access by the controlling authorities.
In this regard, a report was drawn up and sent to the General Prosecutor's Office.
The Military Prosecutor's Office, in turn, sent a submission to the authorized body to rectify the violations. As a result, disciplinary measures were taken against the responsible official.
Only after this, on November 3, 2025, the Ombudsman Institute managed to conduct monitoring in the center, which revealed serious violations of the conditions of detention and the rights of foreigners.
At the time of the inspection, there were 160 people in the center, and the sanitary and hygienic conditions were deemed unsatisfactory. The internal toilets were closed, and only three portable toilets were installed outside.
The building of the center consists of two blocks and is not equipped with a heating system. Air conditioners are installed inside, but they only function in four rooms; it is cold in the other areas.
The outdoor showers were built in a makeshift manner and represent temporary structures.
Moreover, foreigners are forced to cook food outside, even though there is a designated cook in the center, indicating improper fulfillment of duties related to providing balanced nutrition.
Detainees are also deprived of access to legal assistance and communication, as their mobile phones have been confiscated and the use of other means of communication is prohibited. This creates difficulties in communicating with relatives, lawyers, and interpreters.
This situation violates Article 61 of the Constitution of the Kyrgyz Republic and Article 13-1 of the Law of the Kyrgyz Republic "On Guaranteed State Legal Assistance," which guarantees the right to receive qualified legal assistance for foreign citizens.
As a result of the monitoring, an official appeal was sent to the Cabinet of Ministers of the Kyrgyz Republic with a proposal for comprehensive measures to eliminate the identified violations.
In December 2025, lawyers for the detained foreigners contacted the Ombudsman Institute, after which the institute's staff again went to the center.
However, they were once again denied the opportunity to meet with the applicants and conduct monitoring. An additional permit was requested at the checkpoint.
In connection with the repeated obstruction of the Ombudsman's activities, a response report was drawn up, which was also sent to the General Prosecutor's Office.
The Ombudsman Institute calls on the Ministry of Internal Affairs to take measures against officials who hinder the lawful activities of the Ombudsman and ensure transparency in the operations of the Temporary Detention Center.
